Alito's DOJ application, 1985

From Findlaw

The link takes you to a second page of the application, where he states his own particular views. Again, for our purposes, how might this be biewed by an attitudinalist? a constitutive scholar?

This is a bit late to the discussion, but Frontline produced a documentary on US Torture policy. It's available for free at http://www.pbs.org/wgbh/pages/frontline/torture/. It includes an interview with John Yoo, one of the DOJ attorneys who wrote the Bybee memo. The transcript of his interview is at http://www.pbs.org/wgbh/pages/frontline/torture/interviews/yoo.html#3. It's quite interesting stuff.
